Terms of Service

Draft — pending review by legal counsel before public launch.

Last updated: [DATE TO BE FILLED ON PUBLICATION]

1. Introduction

These Terms of Service ("Terms") govern your use of Foxden, a virtual private network (VPN) service operated by [LEGAL COMPANY NAME] ("Foxden", "we", "us", "our"), a company registered in the Meydan Free Zone, Dubai, United Arab Emirates, with company registration number [NUMBER TO BE FILLED].

By creating a Foxden account, downloading our app, or using our service, you agree to these Terms. If you do not agree, do not use Foxden.

These Terms work together with our Privacy Policy, which is available at foxdenvpn.com/privacy.

2. The service

Foxden is a VPN service that provides encrypted connections between your device and our servers, allowing you to route your internet traffic through our infrastructure. We offer the service through our Android application, our website, and any other clients we may release.

Foxden is provided "as is". We work hard to keep the service running reliably, but we do not guarantee that it will be available without interruption, that it will be free of bugs, or that it will work with every website, application, or service you wish to access.

In particular, some streaming services, financial services, and other websites actively block VPN traffic. We do not guarantee that any specific third-party service will work through Foxden, and we do not consider it a defect in our service if a specific website or app does not work while you are connected.

3. Your account

To use Foxden, you create an account, which is identified by a randomly generated account number. You are responsible for keeping this number safe. We cannot recover your account if you lose the number, because we do not collect any personal information that would allow us to verify your identity through other means.

Creating a Foxden account is free of charge and requires no personal information. An account alone does not provide access to the VPN — you must have paid time available on your account (see Section 4) to connect.

You must be at least 16 years old to use Foxden. By using the service, you confirm you meet this requirement.

You are responsible for the activity that takes place on your account. If you believe your account has been compromised, contact us at support@foxdenvpn.com immediately.

Each account may register up to five devices at a time. You can remove a device at any time from the device-management screen in the app or on our website to free a slot.

4. Paid time

Foxden uses a one-off, time-credit billing model. There is no subscription and no recurring charge. You buy a fixed amount of connection time, it is added to your account, and it counts down. When your paid time runs out, you simply stop being able to connect until you top up again. An active balance of paid time is required to connect to the VPN.

4.1 How paid time works

Each purchase adds a fixed number of days of access to your account. Paid time begins counting from the date of purchase and expires when the purchased period elapses. You may top up at any time; additional purchases extend your existing paid time.

4.2 Prices and packages

Foxden offers the following one-off packages:

  • 30 days — USD 4.99
  • 90 days — USD 11.99
  • 365 days — USD 39.99

Prices are in US dollars. Local currency conversion and any applicable taxes are handled by the payment processor.

We may change these prices or packages in the future. Any change applies only to purchases made after the change takes effect; it does not affect paid time you have already purchased.

4.3 Payment methods

Within the Android app, paid time is purchased through Google Play in-app purchases. Through our website, we may also offer payment by card, PayPal, and cryptocurrency. The available methods may change over time. Each purchase is processed by the relevant payment provider; we do not receive or store your payment-instrument details (see our Privacy Policy, Section 4.2).

4.4 No subscription, no auto-renewal

Every purchase is a single, one-time charge. We do not enrol you in a subscription, we do not store a payment instrument against your account, and we will never automatically charge you again. If you want more time, you choose to buy it.

There is no free tier and no free connection time granted at signup.

4.5 Refunds — 7-day money-back guarantee

We offer a 7-day money-back guarantee on your first-time purchase of paid time. If you are not satisfied within 7 days of that first purchase, contact us at support@foxdenvpn.com and we will issue a full refund. No reason required.

The guarantee applies once, to your first purchase only. Subsequent top-ups are not covered by the money-back guarantee.

When a refund is issued, any remaining paid time is removed from your account and your ability to connect ends; you keep whatever time you have already used, and there is no remaining balance. Refunds are processed through the original payment method.

For purchases made through Google Play, you may also request a refund directly through Google Play; whether such a refund is granted is generally at Google's discretion. We will not unreasonably oppose refund requests for genuine service problems.

If you have already received a refund and subsequently purchase again, the money-back guarantee does not apply to the new purchase.

5. No data caps or speed throttling

Foxden does not impose a monthly data allowance, and we do not throttle your connection speed after a usage threshold. Your paid time is measured in days of access, not gigabytes. Within the normal operation of the service, you may use it as much as you like.

This does not override the Acceptable Use rules in Section 6, and it does not prevent us from taking action against usage patterns that threaten the stability of the service for other users (for example, activity indicative of automated abuse).

6. Acceptable use

Foxden is a privacy tool. We respect that what you do online is your business. However, there are a small number of activities that we strictly prohibit because they cause serious harm to others or to the operation of our service:

  • Child sexual abuse material (CSAM): Any creation, distribution, possession, or facilitation of CSAM is forbidden and will result in immediate account termination and reporting to relevant authorities.
  • Attacks on others' infrastructure: You may not use Foxden to launch denial-of-service attacks, attempt unauthorized access to systems you do not have permission to access, or otherwise attack third parties.
  • Mass unsolicited communication: You may not use Foxden to send spam, phishing messages, or large volumes of unsolicited messages.
  • Activities that endanger the service: You may not use Foxden in ways that disrupt our infrastructure, attempt to circumvent technical limits we have set, or threaten our ability to provide the service to other users. This includes sharing a single account's credentials or configuration files in order to provide service to more people or devices than the account permits.

You are responsible for ensuring your use of Foxden complies with the laws that apply to you in your jurisdiction. We do not police lawful activity.

If we discover a clear violation of the rules above, we may suspend or terminate your account without refund. We reserve discretion in how we apply these rules but commit to applying them in good faith.

7. Intellectual property

Foxden, the Foxden name, the Foxden logo, and the Foxden app are owned by [LEGAL COMPANY NAME]. You receive a limited, non-exclusive, non-transferable license to use the Foxden app for personal, non-commercial use, as long as your account is in good standing.

You may not redistribute, modify, reverse-engineer, or commercially exploit our software, except to the extent permitted by law (for example, where reverse-engineering rights are protected by your local consumer protection law).

If we open-source any component of Foxden, that component will be governed by its own license, which will take precedence over this section for that component.

8. Disclaimers

Foxden is provided "as is" and "as available", without warranty of any kind, express or implied, except where prohibited by applicable law.

In particular, we do not warrant that:

  • Foxden will be available at all times.
  • Foxden will work with every website, app, or service.
  • Foxden will protect you from every form of online surveillance or attack.
  • Speeds will be consistent across all servers and times.
  • Specific server locations will remain available indefinitely.

A VPN is one component of online privacy and security. It is not a substitute for using up-to-date software, strong passwords, encryption of sensitive data, careful judgment about what you share online, or other security practices.

9. Limitation of liability

To the maximum extent permitted by applicable law, Foxden, its operators, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability for any claim arising out of these Terms or the service is limited to the amount you have paid us in the 12 months preceding the claim, or USD 50, whichever is greater.

Some jurisdictions do not allow these limitations. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be limited under applicable law.

10. Termination

You may stop using Foxden at any time by uninstalling the app, removing your devices, and deleting your account. Because there is no subscription, there is nothing to cancel — once your paid time elapses, you are not charged again.

We may terminate or suspend your account if:

  • You violate the Acceptable Use rules in Section 6.
  • You attempt to defraud our payment systems.
  • A payment processor reverses charges associated with your account (for example, a credit card chargeback).
  • We are required to do so by valid legal process.
  • We discontinue the service.

If we terminate your account for cause under this section, we are not obligated to refund any unused paid time. If we discontinue the service generally, we will provide a pro-rated refund of any unused paid time where reasonably practicable.

11. Changes to the service or these Terms

We may modify Foxden over time. This includes adding features, removing features, changing server locations, and adjusting the packages and prices of paid time.

We may also update these Terms. When we do, we will update the "Last updated" date at the top, and for material changes we will notify users through the app or by other reasonable means at least 30 days before the changes take effect.

Continued use of Foxden after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the service. If a change is material and you have unused paid time, you may request a pro-rated refund of that unused time within 30 days of the change.

12. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates and, where applicable, the laws and regulations of the Meydan Free Zone, Dubai.

Disputes arising from these Terms or the service will be resolved in the courts of Dubai, United Arab Emirates, except where local consumer protection law in your jurisdiction grants you the right to bring proceedings in your local courts. In that case, you may bring proceedings in your local courts, and we will not contest jurisdiction on that basis.

We encourage you to contact us at support@foxdenvpn.com before initiating formal proceedings. Most disputes can be resolved through direct conversation.

13. Miscellaneous

Entire agreement. These Terms and our Privacy Policy together constitute the entire agreement between you and Foxden regarding the service.

Severability. If any part of these Terms is found unenforceable, the remaining parts continue to apply.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.

Assignment. You may not assign your rights under these Terms. We may assign our rights to a successor entity (for example, in the event of a merger or sale of the company), provided the successor honors these Terms.

No third-party beneficiaries. These Terms create rights and obligations only between you and Foxden. No third party has any right to enforce them.
